Who is responsible for your information?

AGUIACORP LTD is the controller for personal information used to operate the Red Growth store where we determine the purposes and means of processing. This notice explains our collection, use and sharing of information when you browse, order, create an account or contact us. Our current sales market is the United Kingdom. Shopify hosts our store and may also process information for its own purposes as explained below.

Information and sources

We collect contact, billing and delivery details; order, transaction and payment-status information; account details and preferences when you create an account; and messages you send to support. Payment information is handled through the payment providers used at checkout. We also receive device, browser, IP-address and usage information through Shopify and cookies or similar technologies. Information comes from you, your interactions with the store and service providers involved in payment, fraud prevention, fulfilment and delivery.

Purposes and lawful bases

  • To process purchases, arrange delivery, manage accounts, handle cancellations and provide support: performance of a contract or steps at your request before a contract.
  • To maintain accounting records, respond to lawful requests and meet consumer or other legal duties: compliance with legal obligations.
  • To secure the store, prevent fraud, handle disputes and improve the service: our legitimate interests in operating and protecting the business, balanced against your rights.
  • For optional marketing and non-essential cookies where consent is required: consent. Where the law permits marketing on another basis, you can still object and unsubscribe. Consent can be withdrawn without affecting processing already lawfully carried out.

We need relevant contact, payment and delivery information to fulfil an order. If it is not provided, we may be unable to supply the goods. Marketing consent is not a condition of purchase.

Who receives information?

We share necessary information with Shopify, payment providers, IT and hosting services, customer-support providers, suppliers and carriers involved in fulfilling your order. Marketing and analytics providers may receive information where the relevant features are enabled and subject to applicable choices and legal requirements. Information may also be disclosed with your instructions, to professional advisers, to comply with law, protect rights or in connection with a business reorganisation subject to appropriate safeguards. We do not ask you to send passwords or full card details by email.

Shopify's role

Shopify processes information to host, operate and improve the services. Certain Shopify features may combine information from interactions with our store, other merchants and Shopify; for processing where Shopify acts as controller, see the Shopify Consumer Privacy Policy. You can also use Shopify's privacy portal to learn about and exercise relevant rights.

Cookies and marketing choices

Cookies and similar tools support cart, checkout, security and other store functions. Optional analytics or advertising technologies depend on enabled services and applicable consent requirements. Use the store's cookie/privacy controls where available and your browser settings to manage choices. Blocking essential cookies can affect checkout. You can unsubscribe using the link in marketing emails or contact us; transactional order and support messages may still be sent.

International processing, including China

Shopify and other providers may process information outside the United Kingdom. Products ship from China, so necessary order and delivery details may be shared with suppliers and carriers operating there. International transfers are subject to applicable UK data-protection rules. Where required, a recognised safeguard such as a UK international data transfer agreement, UK addendum or adequacy arrangement must apply. Contact us for information about recipients and the safeguards relevant to your information or to request a copy where available.

Retention and security

We retain information for as long as reasonably needed to fulfil orders, manage the customer relationship, meet accounting and legal duties, resolve disputes and protect the service. The applicable period depends on the record, purpose and legal requirements. Marketing information is retained until you withdraw or object, subject to keeping a minimal suppression record to respect that choice. No system is perfectly secure; take care when sending sensitive information.

Your rights

Subject to applicable conditions, you may request access, correction, erasure, restriction or portability, object to processing based on legitimate interests and object to direct marketing. You may withdraw consent where used. If a solely automated decision with legal or similarly significant effects applies, you may have rights to request human intervention and challenge it. Email us to exercise your rights. We may need proportionate proof of identity and normally respond within one month; lawful extensions or exceptions may apply. You will not be penalised for exercising your rights.

Children and other websites

The store and product offer are intended for adults. Contact us if you believe a child has supplied personal information. Third-party websites linked from this store have their own privacy practices; read their notices before sharing information.

Complaints and updates

Contact us first if you have a concern, or complain directly to the UK Information Commissioner's Office at ico.org.uk/make-a-complaint. We may update this notice as practices or legal requirements change, publish the updated version and provide further notice where required.
